The bearer hereof Thomas McIlvane, a Private of Capt. Ellis Company I 79th Reg't, Indiana aged 43 years, 5 feet, 6 inches high, fair complexion grey eyes, dark hair and by profession a farmer; born in the State of Ohio and enlisted at Williamsburg in the State of Indiana on the 2nd day of August eighteen hundred and sixty two, to serve for the period of three years having filed at these Head-Quarters Certificates of Disability, approved by the Medical Director of this Department, for his discharge from the service of the United States, which cannot be perfected for want of Descriptive Roll and account of pay and clothing; the said Thomas McIlvain his own request and by advice of said Medical Director to Save Life is permitted to go to his home at in the County of Johnson State of Indiana and there to remain until his discharge can be completed, which will be duly transmitted to him through the mail. Subsistence has been furnished to the said Thomas McIlvaine to the 31st day of July 1863, and transportation from to Given under my hand at Louisville, Kentucky, this 31st day of July 1863.

Thomas McIlvain a Private of Captain Wait Howe Company I of the 79th Ind Regiment of Vol Infty was enlisted by S.P. Oyles at Indianapolis Ind on the 14th day of August 1862 to serve 3 years; he was born in Belmont Co. in the State of Ohio, is 42 years of age, 5 feet 10 inches high, dark complexion, blue eyes, brown hair and by occupation when enlisted a Farmer. During the last two months said soldier has been unfit for duty _____days.

DECLARATION FOR WIDOW'S ARMY PENSION.

State of Indiana ss

County of Johnson

On this 10 day of February "A.d. one thousand eight hundred sixty four personally appeared before me, John W. Wilson, Clerk of the circuit Court within and for the County and State aforesaid Ann Elizeth (sp) McIlvain a resident of in the County of Johnson and State of Indiana aged 43 (note: possibly 42) years who being first duly sworn according to law, doth, on the oath, make the following declaration, in order to obtain the benefit of the provisions made by the act of Congress, approved July 14, 1862, That she is the widow of Thomas M. McIlvain who enlisted in the servce (sp) of the United States at Williamsburgh Johnson Co. in the State of Indiana on the Second day of August 1862 as a Private in Company "I" commanded by Captain Ellis in the 79th Regiment of Indiana Inf. Volunteers in the war of 1861; who while in the service aforesaid, and in the line of his duty, contracted the chronic Diarrhea from which cause and disease he died at home Johnson Co in the State of Indiana on the 13 day of September A.D. 1863. She further declares that she was married to the said Thomas McIlvain in the County of Guernsey and State of Ohio on the 28th day of March in the year 1839 that her name before her said marriage was Ann Elizabeth Boone

That her husband, the aforesaid Thomas McIlvain died on the day above mentioned and that she has remained a widow ever since that period, as will more fully appear by reference to the proof hereto annexed. And further, that the following are the names and dates of births of the children of the said Thomas McIlvain now living, who are under sixteen years of age at the time of his decease, viz. Thomas M. McIlvain born on the 19th day July 1856, Arminda J. McIlvain born on the 14 day of November 1854.

She also declares that she has not, in any manner, been engaged in or aided or abetted the rebellion in the United States. She hereby appoints Carlin Hamlin of Indianapolis State of Indiana her true and lawful Attorney, with full power of substitution to prosecute this claim for pension, and to receive the certificate which may be issued therefor. She requests that her pension be paid at Indianapolis State of Indiana. Her post office address is Ninevah, County of Johnson, Sate of Indiana.

Also personally appeared McLain McIlvain and Panter McIlvain residents of County of Johnson, State of Indiana, whom I certify to be respectable and entitled to credit, and who being by me first duly sworn, say they were present and saw Ann Elizabeth McIlvain sign her name to and make oath to the foregoing declaration and power of attorney; and they further swear that they have every reason to believe, from the appearance of the applicant, and their acquaintance with her, that she is the identical person she represents herself to be; that they have been well acquainted with her and her said husband Thomas McIlvain deceased, for all their lives and know they lived together as husband and wife, and were so reputed; that they were present at their marriage in Guernsey County, State of Ohio on the 28 day of March 1839, and were eye witnesses to the fact, that the names and ages and residence of this children as represented by her in the foregoing declaration are true, as they verily believe, and also that they are the only children of said Thomas McIlvain under sixteen years of age at the time of his decease. The further declare that she has remained a widow ever since her husband's decease, and that she has not, in any manner aided or abetted the rebellion; and that they have no interest in the prosecution of this claim.

Jacob A. Marshall of lawful age being duly sworn on his oath states that he is a Regularly practicing physician, that he was personally acquainted with Thomas McIlvain dcd. Of Co I 79 Ind Vol that on or about the 1st day of August 1863 the said Thomas McIlvain decd came home from the hospital at Louisville Kentucky dangerously sick with a severe form of Chronic Diarrhea that he was the attending Physician until his death which occurred on the 13 day of September 1863 - that he can safely state that he died of the same disease with which he was afflicted on his arrival at home - which from all the circumstances attending the case the affiant verily believes was contracted in line and discharge of duty as a soldier. There is no hereditary disease or sickness in his case, he having died solely of the said disease caused by the service and contracted in line and discharge of duty as the affiant? Verily? ? as aforesaid. Jacob A. Marshall.

I have the honor to acknowledge the receipt from your Office of application for Pension No. 45,514 and to return it herewith, with such information as is furnished by the files of this Office.

It appears from the Rolls on file in this Office that Thomas McIlvain was enrolled on the 14th day of Aug't 1862 at Franklin Ind. In Co. "I" 79 Regiment of Ind'a Volunteers, to serve three years, or during the war, and mustered into service as a Sergeant on the 26 t day of Augt, 1862 at___in Co. "I" 79 Regiment of Ind'a Volunteers, to serve three years, or during the war. On the Muster Roll of Co. "I" of that Regiment, for the months of July and August 1863 her is reported a private "Discharged Augt 14 1863 at Louisville Ky by reason of disability by order of Col. M. Mundy". No evidence of death on file.

This is to certify that Thomas McIlvain Srgt Co. I 79 Ind Vol Inftry a former member of this regiment, was by me sent to Hospital at Nashville Tenn. During the month of December 1862, then suffering from the effect of "Camp Fever" her rejoined the Regt at Murfreesboro Tenn., when a forward movement was made from this place in fall of /63, he was again left in Hospital, then laboring under "Chronic Diarrhea," which disease was contracted while in service of United States Army, from effect of which he died in Fall of /63 at his home in Indiana.

The certificate of disability for discharge shows that he was discharged on account of Chronic Diarrhea. The affidavit of Dr. Jacob A. Marshall, shows that he was the attending Physician, and that the soldier died at home, Sept 13th, 1863, of Chronic Diarrhea.

DECLARATION FOR WIDOW'S INCREASE OF ARMY PENSION.

Under Act of July 25, 1866.

On this thirtieth day of November A.D. one thousand eight hundred and sixty six personally appeared before me, John W. Wilson, Clerk of a Court of Record, within and for the County and State aforesaid, Ann Elizabeth McIlvain a resident of Hurley? Township in the County of Johnson and State of Indiana aged 46 years who being first duly sworn according to law, doth, on her oath, make the following declaration in order to obtain the benefit of the provisions made by the second section of the Act of Congress increasing the pensions of widows and orphans, approved July 25, 1866. That she is the widow of Thomas McIlvain who was a Private in Company "I" commanded by Captain William B. Ellis in the 79 Regiment Indiana Infantry Vols in the war of 1861 and who died by reason of Chronic Diarrhea a disease contracted in the …. And that by reason of his death in the service aforesaid she has been granted a pension of eight dollars per month in accordance with a certificate numbered 41803 being date the 27th day of February 1865. She further swears that she has the following named children of her deceased husband and herself under sixteen years of age, who are now living, the dates of whose births were as given below, to wit Arminda J. McIlvain who was born on the 14th day of November 1854 and Thomas M. McIlvain who was born on the 19th day of July 1856 who are the minor children and only minor children of the aforesaid Soldier deceased both of whom she says reside with her and applicants …. Who she says she makes provision infull. She further declares that she has not remarried since the death of her said husband, nor has she abandoned the support of any one of the children above named, nor permitted any one of the same to be adopted by any other person or persons as his, her, or their child.

And further that her said husband has left no minor children by a former marriage. She also refers to her former application No 41803 now on file in the pension office of the United States together with the evidence therein filed to establish this her claim for an increase pension under the act above refered to and she hereby constitutes and appoints Charles W. Snow of Edinburgh State of Indiana her true and lawful Attorney, with full power of substitution to prosecute this claim for pension, and to receive the certificate which may be issued therefor.

Burton a resident of Johnson County, State of Indiana and William Hague a resident of Johnson County, State of Indiana, persons whom I certify to be respectable and entitled to credit and who being duly sworn, according to law, declare each for himself, that they well know Ann Elizabeth McIlvain who signed her name to the foregoing declaration and Power of Attorney in their presence; and that she is the identical person she represents herself to be in said declaration; that the names, ages and residence of her and her said husband's children are as represented by her in the foregoing declaration are true, as they verily believe; and also, that the two children named by her are the only children of said Thomas McIlvain deceased under sixteen years of age. And that she has no abandoned the support or any one of the children of said Thomas McIlvaine above named nor permitted any one of the same to be adopted by any other persons as his, her or their children; and that her said husband Thomas McIlvain has left no other children by a former marriage.

They further declare that she has remained a widow ever since her said husband's decease, and that she has not in any manner aided or abetted the rebellion. They say that the answer of minor children …. As above was as the order…stricken and Thomas McIlvain inserted below.

They further swear that they, or either of them, have no interest in this claim, either present or prospective; and that they are not concerned, directly or indirectly, in its prosecution, and are not near relatives of the claimant.

O this 16th date of April, 1867, personally appeared before me, a Notary Public in and for the County and State aforesaid, Rebecca McIlvain and Susanna Burton, of Ninevah Township, in the County of Johnson and State of Indiana, personally known to me, who being duly sworn according to law, declares that the ages are as fol.. Rebecca McIlvain 47 years and Susannah Burton is 49 years of age, and that they are well acquainted with Ann Elizabeth McIlvain who was the wife of Thomas McIlvain, late of the 79th Regiment, Indiana volunteers, and that they was (sp) present at the birth of the following children of said Ann Elizabeth McIlvain and Thomas McIlvain at the time and place as follows, to-wit: Arminda J. McIlvain who was born on the 14th day of November 1854, and Thomas McIlvain who was born on the 19th day of July 1856 both of whom were born the above named parents while they lived together as husband and wife in Johnson County, Indiana and that they acted at the time in the capacity of assistant to Doctor Ward who is now d… and that they have no interest in the prosecution of the claim for pension this affidavit is sought to establish.

On this third day of June a.d. one thousand eight hundred and seventy personally appeared before me John w. Wilson Clerk of the Circuit Court within and for the County and State aforesaid Ann E. Hart formerly Ann E. McIlvain a resident of Ninevah Township in the County of Johnson and State of Indiana, aged Forty Nine years, who being duly sworn according to law, doth, on oath, make the following declaration, as guardian of the minor children of Thomas McIlvain deceased, in order to obtain the benefit of the provisions made by the act of Congress, approved July 14, 1862, granting pensions to minor children, under sixteen years of age, of deceased officers and soldiers. That she is the guardian of Arminda J. McIlvain and Thomas M. McIlvain (these being the only children of deceased, under sixteen years of age,) whose father was a Private in Company I, Commanded by Captain William B. Ellis in the 79 Regiment of Indiana Volunteers in the war of 1861; who wile in the service aforesaid ind in the line of his duty, and while there on sick leave (Furlough) died at his home at Ninevah Township at the County of Johnson in the State of Indiana on the 13th day of September 1863, by reason of Chronic Diarrhea a disease contracted while in the United States Service and in the line of his duty. That the mother of the children aforesaid is now the wife of John Hart having intermarried with him at the County of Johnson in the State of Indiana on the thirteenth day of September, 1868, and that the date of the births of her wards, and their residence are as follows: Arminda J. McIlvain born on the fourteenth day of November 1854, and Thomas M. McIlvain was born on the 19th day of July 1856 and both reside with applicants their Guardian and Mother - at Ninevah Township in Johnson County Indiana

On this 3d day of June 1870 before me John M. Wilson Clerk of the Circuit court within and for the County and State aforesaid personally came Rebecca J. McIlvain a resident of Ninevah Township Johnson County Indiana aged 32 years and Doctor J.M. Marshall a resident of Ninevah township Johnson County Indiana aged 38 years both of whom being duly Sworn according to law upon their oaths say? That they have been for 20 years past been well acquainted with Ann E. Hart formerly Ann E. McIlvain who was the wife of Thomas McIlvain late of the 79th Rgt Indiana Volunteers as well as with the said soldier Thomas McIlvain and they say that the said soldier while home on sick furlough died at the township of Ninevah in the County of Johnson in the State of Indiana on the 13th day of September 1863 by reason of Chronic Diarrhea a disease contracted while in the United States Service and in the line of his duty - they say that they were present at the time of said soldiers death as aforesaid and attended his funeral that he was very sick when he came home from the army and died in a short time of the aforesaid disease of which he was so diseased when he came home. Hart formerly Ann E. McIlvain who was the wife of Thomas McIlvain late of the 79th Regiment of Indiana volunteers and that they were both present at the births of the following children of said soldier Thomas McIlvain and Ann E. McIlvain now Ann E. Hart at the times and places following to wit Aminda J. McIlvain who was born at the County of Johnson in the State of Indiana on the 14th day of November 1854 and Thomas M. McIlvain who was born at the county of Johnson in the State of Indiana on the 19th day of July 1856 and that they acted as the respective time? Named as assistant accouctears? And afficants say that both of said children are still living and are the only children now sixteen years of age of said soldier deceased affiants further say that they have no interest in the …. In Testimony Whereof, I John W. Wilson Clerk of the Johnson Circuit Court, hereunto subscribe my name and affix the Seal of said Court, at Franklin?? this 11 day of September, 1868. John Wilson, Clerk.

Be it further remembered that afterwards, to=wit: on the 24 day of September, 1868, the following certificate of marriage was filed in my office, to=wit:

Dates of birth: Affdvts of Rebecca Burgis and Rebecca J McIlvain, the attending midwives.

Service. The adjutant general U.S.A. reports name on rolls as Thomas McIlvain and the rank, company and regiment and the dates of enlistment, muster and dischargs as state on preceding pages. He also reports____

Death. The adjutant general reports "No evidence of death." J.H. Tilford, apt ? 79 Ind vols certifies "that said McIlvain was sent to Hosp. At Nashville Tenn in Dec 1862 then suffering from Camp Fever. He rejoined the Regt at Munfreesborro Tenn. When a forward movement was made from this place in the Fall of '63. He was again left in Hosp. Then laboring under chronic Diarrhea which disease was contracted in the service from effects of which he died at his home in Ind. In the Fall of '63." Cert of Dis: shows discharge for Chr. Diarrhea, Dr. J.A. Marshall swears that he attended said McIlvain from about Aug 1, 1863, when he came home from Hospital at Louisville. Dangerously sick with a severe form of Chronic Diarrhea. He died of said disease Sept 13, 1863.
