On this day this cause coming on ..able heard the plaintiff appearing by his attorney and the defendants, George T. Nesbit, Robert s. Nesbit and Samuel A. Nesbit appearing by their...., and the defendant Joseph M. Nesbit appearing by his....Peylin f. Greenwood....lawfully appointed him and neither party requiring a jury this cause is submitted to the court for trial And the court after hearing the evidence finds that in the .....day of December 1874, Samuel Nesbit made and entered into a contract with Plaintiff John McDonald Anderson that if the said Anderson would come and live upon the farm of said Nesbit with said Nesbit and take care of said Nesbit and his property during his natural life, that at this (Nesbits) death all his personal property and the following described Real Estate to wit: The South west quarter of the North west quarter-and the North West quarter of the South West quarter of Section Twenty two (22) in Township Sixty two (62) of Range fourteen (14) in Adair County Missouri and the undivided half of the West half of the North East quarter and the North East quarter of the North East quarter of Section Seven (7) in Township fifty eight (58) West of Range twelve (12) west in Shelby County Missouri, Except one old small house called ...... and six Bee Stands, should upon the death of him, the said Nesbit be and become the absolute property of the Said John M. Anderson. The court further finds that the said Anderson has fully complied with his part of said contract and the said Nesbit died in Adair County Missouri on the 14 day of February 1877. The court further finds that the defendants are the only heirs at law of the said Samuel Nesbit. It is therefore ordered adjudicated and decreed by the court that all the right title interest and estate of the defendants of in and to the Real Estate above described by and the same is hereby decreed to and vested in the Plaintiff as fully and completely as though the same had been duly and legally conveyed to him by the said Nesbit in his lifetime. And by agreement of Parties each party to pay his own costs him and that execution to issue therefore. |
